Website Care Plan Graphic Design Tasks Terms and conditions

The terms and conditions defined below govern all transactions between Blue Dog Digital Marketing and its respective Clients, for the sale and provision of Graphic Design Services by Blue Dog Digital Marketing to its Clients. Please read these term and conditions carefully. These terms are subject to change without notice, at any time, without prior notice.

As part of some of the Blue Dog Website Care Plan Packages a certain number (as per the Care Plan packages found here) of Graphic Design Tasks are included. These tasks are as follows:

Graphic Design Services Offered as part of Website Care Plans

One Graphic Design Task is considered one of the following:

Business Card design

Flyer or Poster

4 Page Brochure

Letterhead

Powerpoint Template (First page + 3 subsequent pages)

T-Shirt/Mug/Magnet

Packaging Label or Tag

eBook/Book/CD Covers

One Sign/Pullup Banner

Gift Card/Certificate

Sticker/Decal

Facebook/Linkedin/Twitter Header Image

Meme design

Image Cropping/Resizing

Image Background Removal

Add Your Logo to Existing Image

Tweak an Existing Graphic (PSD files to be supplied)

Delivery

All products provided by Blue Dog Digital Marketing will be delivered electronically via email. It is the client's responsibility to ensure a current and correct email address is provided to Blue Dog Digital Marketing.

Accrual

The Graphic Design Tasks that form part of the Website Care Plan Packages DO NOT ACCRUE should the Client be unable or choose not to utilise the Graphic Design Tasks for a month(s). 

Acceptance of Agreement

The use of services provided by Blue Dog Digital Marketing constitutes an agreement to these terms and the Blue Dog Digital Marketing standard terms and conditions.

Allocated Design Changes

For each Graphic Design Task there is a limit of Two sets of design changes that can be requested by the Client prior to signing off of the design.

A single set of design changes is defined as a series of changes requested in one email or meeting. Once both sets of design changes have been completed, any additional changes will require an additional payment to complete.

Additional Changes Charges

Any additional changes requested by the Client after the initial Two Design Changes have been completed will be quoted by Blue Dog Digital Marketing at the standard hourly rate (minus the discount for Website Care Plan Clients) and completed after Client approval and payment.

Delivery of each Graphic Design Task

Each Graphic Design Task will be completed and provided for the initial review within 10 working days from the date all information and elements required to complete the design are received.

Subsequent changes will be completed within 5 working days.

Once each Graphic Design Task is completed it is provided to the client including all working files. 

30-day Completion Rule

Should we not hear from the client within a period of 30 days after presenting a Graphic Design Task for a review the task will be deemed complete and the job closed.

Any changes received after this 30 day period will be considered a NEW Graphic Design Task.

Content

Any required content that is to be provided by the Client must be at the highest resolution possible. Blue Dog Digital Marketing is not responsible for the quality of a Graphic Design Task if the content provided is not suitable.

The delivery time of a Graphic Design Task begins once all required content has been received from the Client.

Refunds

Any Graphic Design Task that forms part of a Website Care Plan shall not be refunded if the Client is unable or chooses not to utilise that service for any given time. These tasks DO NOT accrue on a month by month basis.

Any Graphic Design Task that forms part of a Blue Dog Website Care Plan is included at a severely reduced price. Due to this low cost if for any reason you are not happy with the Graphic Design Task design provided there is no refund available. 

If a Graphic Design Task was paid for separately by the Client and is cancelled by the Client a refund, minus the cost of work completed will be provided to the Client within 45 day period from cancellation.

Ownership of Files and Content

If there are no outstanding monies, all files and data, design, images, logos and content are considered the Clients property however Blue Dog reserves the right to charge a fee should a copy of the files be required.

Intellectual Property & Confidentiality

If there are no outstanding monies the intellectual property of all Graphic Design Tasks created by Blue Dog Digital Marketing is transferred to the Client at the time of completion of the task and Blue Dog Digital Marketing agrees to make no claim of copyright or ownership whatsoever.  

All intellectual property of any type will also remain confidential and not be shared with any other party. Please see Blue Dog Digital Marketing standard terms and conditions for more details on confidentiality and intellectual property.

Cancellations

Should the Client cancel a Graphic Design Task after the task has been submitted and work has begun the task submitted will be counted as a Graphic Design Task for that month's subscription.

If the cancelled Graphic Design Task was paid for separately a refund, minus the cost of work completed will be provided to the Client within 45 day period from cancellation.

Receipt of Graphic Design Task

All Graphic Design Tasks must be received via the allocated support ticket system found at the top of the Blue Dog Digital Marketing Website and found here. Any tasks received outside of this avenue will not be considered a task to be completed. 

Client Contact Person

The Client agrees to nominate ONE suitable primary coordinator within their organisation to act as the sole points of contact with Blue Dog Digital Marketing for any Graphic Design Task matters.  Blue Dog Digital Marketing will only receive communication from the nominated Client coordinators.

Portfolio

The Client agrees that Blue Dog Digital Marketing may use the work and the Client’s name and identity as part of its portfolio of works for the purposes of promoting and advertising Blue Dog Digital Marketing unless the Client specifically requests otherwise. 

Limit of Liability

Whilst all efforts will be made to ensure premium service to the Client, due to the personal nature of Graphic Design Tasks Blue Dog Digital Marketing does not claim infallibility and, in particular, cannot guarantee the satisfaction of the service.

The Client agrees to hold Blue Dog Digital Marketing totally harmless for any damages, which may occur as a result of any delay of services, errors, omissions, missed deadlines, or any other event relating to the services provided by Blue Dog Digital Marketing.  In addition, the Client agrees that Blue Dog Digital Marketing will not be held responsible for services provided by other third party suppliers. Variations

Blue Dog Digital Marketing reserves the right to vary any aspect of this Agreement, or any services, including charge rates, at any time.  It will be deemed that the Client has accepted any such variation unless a notice of termination is received.
